These Terms of Use (“Terms”) govern your use of our online platform, www.filavitae.org (“website” or “Fila Vitae platform”), our courses and other products and services (“services”) that we offer.

Acceptance of terms

By visiting our website, becoming a student, contracting any of our services or using any information, tools, resources and functionality of Institute Fila Vitae, you agree, with no restriction, to comply with these Terms and all other applicable policies and principles.

Therefore, please read these Terms carefully and contact us if you have questions.

If you do not agree with all the conditions expressed in these Terms, do not use our services.

Use of our services

Your right to access and use our services is personal, limited, non-transferable, non-exclusive and revocable.

You may use our services only if you can enter into a binding contract with Fila Vitae Institute and only in compliance with these Terms and other applicable regulations.

If you cannot be characterized as responsible, the obligations established in these Terms will be transferred to your legal guardians.

Most of our services are for exclusive use by allowed users. You commit not to attempt, to access improperly and/or facilitate others to access improperly such services.

In this way, you agree not to share with any third party the data of your access account to the Fila Vitae platform, such as your username and password, which must be kept confidential.

If you notice or suspect any unauthorized use of your Fila Vitae platform account, you must notify us immediately.

You are also responsible for keeping your registration information up to date, accurate and complete. If you do not, the provision of our services to you may suffer damage or even be prevented.

At our sole discretion, your account may be ended or changed at any time. We are not obliged to keep records of any data you may have provided to us in using our services.

Availability of services

Your access and use of our services may be interrupted for various reasons, such as a) problems connecting our website to the Internet network; b) impossibility of telephone connection; c) technical and/or operational problems; d) periodic updates, maintenance or repair of our website or other actions that we, in our sole discretion, may deem necessary; e) health problems or other reasons of force majeure that prevent our teachers from providing the due service; and f) fortuitous events or force majeure that prevent the provision of services.

Provision of services

Our courses are characterized as lifelong education and are governed by the relevant legislation. Access to these courses is restricted to those who have paid the respective price and/or have been invited by us.

The material that makes up our courses will be made available on the stipulated dates. Such material will only be available for online viewing, through our website, for up to one (one) year after the date of purchase.

The support of teachers during the course will be exclusively in the form of: (i) participation in debate forums and dialogue spaces, where you can post your questions and comments; and, (ii) evaluation and/or comments on your answers to the exercises proposed by us.

With the exception of this, your use of our courses will not be actively monitored by us and is entirely at your own risk.

Participation in one of our courses does not give you the automatic right to the issue of a certificate of participation or completion. The issuance of such a certificate is conditioned to your effective participation in the course and the satisfactory completion, at our sole discretion and the responsible teacher, of all proposed activities. As the issuance of the certificate is manual, there will be a period of up to 60 (sixty) days for its issuance, after proof of compliance with all requirements.

Modification and termination of our services

We may, at any time and without notice, change, suspend or discontinue part or all of our services.

Any modification or elimination of services will be at our sole discretion and with no obligation or liability to you.

Your use of our services does not grant you the right to continuous provision of our services.

Your rights

Fila Vitae Institute grants you a personal, limited, non-transferable, non-exclusive and revocable right to use our services, provided that you have complied with all the provisions in these Terms and other applicable conditions.

You may only use our services for personal, non-commercial purposes. Any use of our services for other purposes is subject to our written and express authorization.

Furthermore, you are only entitled to access and use the Fila Vitae platform for lawful purposes.

Intellectual property rights

All content of our services, including but not limited to our website, video and audio files, texts, images, emails, layouts, illustrations and other materials, are the exclusive property of Fila Vitae Institute and/or its suppliers.

Such content is protected by national and international copyrights, trademarks and other intellectual property rights.

You may not copy, sell, distribute, sub-license, make available, reproduce, publish, change, create derivative works, or commercially exploit the aforementioned content, without the explicit prior express written consent of Fila Vitae Institute.

We respect intellectual property rights and our content is original. However, if you believe, in good faith, that any part of our content violates your intellectual rights, please send us a notification, with all relevant information and evidence, requesting that the material be removed.

Conduct in the forums and dialogue spaces

You are solely responsible for the content of the messages you post on our forums and dialogue spaces.

All content published by you on our forums and dialogue spaces must be respectful and not offensive.

In addition, you agree not to publish content:

  • that is not original or that you have not received consent to publish or make available;
  • with inappropriate language;
  • that is pornographic, sexually explicit, indecent, libidinous or libelous, defamatory, abusive or that discriminates against or threatens others;
  • that violates any rule or regulation or that infringes any right of third party, including (but not limited to) intellectual rights;
  • with virus or any other material that may corrupt, destroy or disable the functioning of the software, hardware or any other system;
  • which may be considered “spam” or undue advertising;
  • that violates any local, national or international law or encourages the commission of unlawful acts.

It is strictly forbidden to use our forums and dialogue spaces for any purpose other than the constructive debate of ideas on the topics that constitute our scope of action.

If we verify that any of your publications do not meet the above requirements, we may remove your post and, if necessary, take any other appropriate administrative and legal measures.

The opinions and messages posted by our members in our forums and dialogue spaces do not reflect the ideas of Fila Vitae Institute.

Privacy policy

Your use of our services and any information provided by you in connection with the use of our services are subject to our Privacy Policy, which can be consulted here.

Payments and refund policy

Payment for the courses must be made through Stripe, as indicated in the course specific information contained on our website.

If, for any reason, payment does not occur on the dates and according to the stipulated conditions, you may have your access to our courses denied and/or suspended, and legal and administrative measures may be taken.

According to our satisfaction and quality policy, the cancellation request can be made up to 30 (thirty) days after you are given access to the course, provided that you have not completed or accessed more than 25% of the content of the course, with a full refund of the amount paid.

After this period, no cancellation requests will be accepted.

Requests for cancellation of any service must be made through the form. The email entered in the form must be the same email address used for registration on the site.

Limitation of liability

The services are provided “as is”, without warranty of any kind, either explicit or implied, including fitness for a particular purpose. By using our services, you assume that any access or use of our services is at your sole risk.

We or our suppliers cannot, in any event, be held liable for any damages, including (but not limited to) loss of profits, business interruption or loss of information resulting from: (i) the use or inability to use our services (ii) any conduct emanating from any member of Fila Vitae Institute, including, without limitation, defamatory, offensive or unlawful conduct; and, (iii) unauthorized access, use or alteration of your content or information.

To the maximum extent permitted by law, the maximum amount for which Fila Vitae Institute is responsible, in any case, is limited to 50,00€ (fifty euros) or the amount eventually paid by you to Fila Vitae Institute for the use of our services in the last six months, whichever is greater.

Indemnity

You agree to indemnify, defend and exempt Fila Vitae Institute and its suppliers and employees from any liability with respect to any claims, losses, costs, damages or expenses incurred in connection with your use or intended use of our services in violation of these Terms or any rules or rights of us or any third party.

Modification of Terms

These Terms may be modified by us, at our sole discretion, at any time. Any change or update will be effective immediately after being published on our website.

We will use our best efforts to notify you of any changes to these Terms. But, in any case, your continued use of the services after the publication of these changes, with or without notice, constitutes acceptance of the Terms with all its modifications.

If you do not agree to the changes to the Terms, you may cancel your registration and discontinue your use of our services.

Miscellaneous

If any provision or part of these Terms is found to be unlawful, void or unenforceable by any mediator or competent court, this shall not entail the illegality, nullity or unenforceability of these Terms as a whole. Only that provision or part of the Terms shall be unlawful, void or unenforceable and shall be disregarded.

If Fila Vitae Institute does not exercise or require any right or faculty provided for in these Terms and applicable legislation, such act shall not constitute a formal waiver of the rights or faculties of Fila Vitae Institute and such rights or faculties may still be exercised by Fila Vitae Institute.
